The point the tech community gave was the one I've always heard from both artists, musicians and so forth - parodies are protected from copyrights. She really doesn't have a case in this matter.
But this ONLY pertains when the parody is of HER work, not when it's a parody USING her work.
It would be up to the judge's interpretation. Her work was representing what was being parodied. Personally, I wouldn't be bothered by it. I have had worse happen to me.
What about Billy Joel's song? It wasn't being parodied. It was only underscoring the point and bringing out the parody.
Billy Joel was given credit. And his work was altered which gives the Richter Scales some minor claims to this being new work rather than purely derivative, but if Joel wanted to fight this, he could since there are legal precedents in this area. Lane's work, however, was used in its entirety and without credit.

wow. i would be upset too if it was my photo. how hard is it to give a person credit, much less just email and ask if you can even use the photo? seems like everyone is just going to have to put the big fat text across all their images now with "copyright" on it so it can't be stolen anymore. how sad.

As a photographer myself, I think that the way the photographer is being treated is unfair. She had every right - as a professional photographer who sells her work to make a living - to request that her photograph be taken down due to unauthorized use.

Furthermore, I'm surprised that Richter Scales even made such an issue about it - just find another picture and move on - don't target the person you abused in the first place.

I wonder what would have happened if they'd just had credited her to begin with - or even better contacted her personally and asked to use the photograph. I'm sure, upon hearing the company's background of being a non-profit organization (which they feel they need to point out now), she would have been more than happy to be apart of such a great video.
